1.0 Our Contract
1.1 These Terms and Conditions govern the supply of goods sold by MCD Home & Garden (Ireland) Ltd, VAT No. 3523988DH (a trading name of MCD Home & Garden Ltd, Company No. 617990), located at West Curragh, Naul, Dublin, K32 YV74 (“we”, “us”, “our”) to the customer (“you”, “your”) and constitute the entire and only agreement between us in relation thereto.
1.2 By placing an order with us, you make an offer to purchase goods subject to these Terms and Conditions. A legally binding contract is formed only when we accept your order—either by dispatching the goods or by sending a written order confirmation.
1.3 Processing your payment or sending an order acknowledgment does not constitute acceptance of your order. We reserve the right to refuse or cancel orders at our discretion, including in cases of stock unavailability, pricing errors, or other legitimate grounds.
1.4 By placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions, as well as our Privacy Policy, which outlines how we collect, use, and protect your personal data.
1.5 We reserve the right to change this site and these terms at any time. Changes will not affect existing contracts unless agreed with you in writing.
2.0 Price & Payment
2.1 The price payable for the goods you order is as displayed on our website at the time you place your order, plus any applicable delivery charges.
2.2 We reserve the right to update prices but will confirm the prevailing price before accepting your order.
2.3 Promotional prices require a valid promotion code.
2.4 Errors may occur; if goods are incorrectly priced, we are not obliged to supply them at the incorrect price.
2.5 Full payment, including delivery charges, must be received before your order can be processed.
2.6 Payments may not be withheld or offset without our written consent.
2.7 Any “Was” price displayed represents the item’s previous selling price for a period of at least 30 days before the reduction, unless stated otherwise.
3.0 Delivery & Collection Policy
3.1 Delivery Timelines and Conditions
3.1.1 We aim to deliver your items in accordance with your order and within the stated delivery timeframes. Standard parcels are typically delivered within 2 to 3 working days within the Republic of Ireland and Northern Ireland.
3.1.2 Please note that stove deliveries may vary due to suppliers and couriers. Delivery times for Hamco, Heritage, Henley Stanley and Atlanic stoves are indicative only and subject to supplier and courier schedules.
3.1.3 All deliveries are subject to availability and may be affected by exceptional circumstances. In any case, we will deliver within 30 days of accepting your order.
3.1.4 If we cannot deliver within 30 days, you may cancel your order before delivery is attempted.
3.1.5 A valid signature is required upon delivery or collection. Please ensure all goods are checked before installation.
3.2 Delivery Restrictions
Deliveries are made only to the exterior of a ground-floor location at the provided address. Any further movement beyond this point is the customer’s responsibility.
3.3 Missed or Failed Deliveries
If delivery fails due to circumstances within your control, we will attempt to reschedule within 30 days. Re-delivery costs will be your responsibility.
3.4 Risk and Ownership
Ownership of goods transfers to you only after full payment and delivery. Until then, goods remain our property and must be stored safely.
3.5 Shipping Address Policy
We ship only to the billing address unless prior arrangements are made. Free in-store collection requires valid photo ID and order confirmation.
3.6 Courier Delays and Third-Party Transport
While we use third-party couriers, we remain responsible for ensuring your goods arrive in good condition. Responsibility transfers only upon receipt by you or your nominee.
4.0 In-Store Collection
In-store collection is available free of charge for online and phone orders. You must bring valid photo ID (passport or driving licence) and your order receipt.
5.0 Availability
We strive to maintain adequate stock levels, but availability is not guaranteed. If we cannot fulfil your order, we may:
- Provide a substitute product of equal or greater value, or
- Refund the full purchase price.
Refunds are processed within 14 days of notification.
6.0 Cancellation & Returns
6.1 Standard Returns (14-Day Policy)
Under EU (Consumer Information, Cancellation and Other Rights) Regulations 2013, you may cancel and return goods within 14 days of receiving them, provided:
- Items are unused and in original condition;
- Returned in original packaging where reasonably possible;
- Include all manuals and accessories; and
- Include valid proof of purchase.
6.2 Refunds
Refunds will be processed using the original payment method within 14 days of receiving the goods or proof of return. Delivery charges are non-refundable.
6.3 Return Shipping & Condition of Goods
You are responsible for return shipping unless the goods are faulty. Returns must be in resaleable condition.
We reserve the right to deduct for diminished value if goods have been handled beyond what is necessary to establish their nature and function.
6.4 Returns After 14 Days
Returns after 14 days are accepted only at our discretion and are not automatically entitled to a refund
6.5 Returns of Opened Package
For customers wishing to return goods after the standard 14-day return period, we may accept returns of opened or used items at our discretion. In such cases:
- A 20% restocking fee applies;
- Items must be resaleable, with original packaging and components;
- Delivery charges are non-refundable;
- Refunds (if accepted) are processed within 30 days of receiving the returned goods.
6.6 Bespoke and Specialist Orders
For bespoke or specially manufactured goods:
- A 30% deposit is non-refundable.
- If full payment has been made, only 70% is refundable.
- If cancelled during production, you remain liable for at least 30% of the order cost.
- No refunds once production has commenced.
6.7 Faulty Goods or Manufacturing Issues
If you believe an item is faulty, you may be asked to provide photographic evidence. We will determine whether the item should be repaired, replaced, or refunded.
7.0 Special Orders and Non-Stock Items
7.1 For specially sourced or non-stock items, a 50% deposit is required.
7.2 If cancelled after we have received the goods, but before delivery, we may retain up to 20% as a restocking fee.
7.3 These provisions do not affect your statutory rights.
8.0 Liability
8.1 Faulty or Damaged Goods
If notified within 30 days, we will, at our discretion:
- Remedy any shortage or non-delivery;
- Repair or replace defective goods; or
- Refund the amount paid.
8.2 Limitations of Liability
We will not be liable for:
- Business-related losses (profits, income, revenue, or interruption);
- Indirect or consequential losses not reasonably foreseeable.
8.3 Consumer Rights & Legal Liability
Nothing in these terms affects your statutory rights. We do not exclude liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation.
9.0 Manufacturer Specifications
All goods are sold per the manufacturer’s specifications and subject to any limitations or instructions included in the documentation.
Trade customers acknowledge that:
- We accept no responsibility for installation or use of goods supplied.
- You assume full responsibility for proper use and installation.
- You indemnify us against any losses or claims arising from improper installation.
Trade customers are not entitled to statutory consumer rights.
11.0 Age Requirements for Specific Goods
By ordering age-restricted goods (e.g., solvents), you confirm you are over 18, and delivery will be received by someone aged 18 or over.
12.0 Termination
We reserve the right to suspend delivery or terminate the contract if:
- You breach these terms; or
- You become insolvent or unable to pay debts as they fall due.
Upon termination, all outstanding amounts become immediately payable.
13.0 Force Majeure
We are not liable for failure or delay caused by circumstances beyond our control, including:
- Strikes, lockouts, or industrial disputes;
- Natural disasters or “acts of God”;
- War or government restrictions;
- Transport delays.
14.0 General Conditions
If any clause is deemed invalid or unenforceable, the remaining terms shall remain in effect.
These Terms are governed by Irish law and subject to the exclusive jurisdiction of the courts of Ireland.
